Digital Millennium Copyright Act Policy

At PcGamePort, we are committed to respecting intellectual property rights and expect others to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), copyright owners or their authorized agents may submit a takedown notice to our designated DMCA Agent. As an internet service provider, we are entitled to protection from infringement claims under the DMCA’s “safe harbor” provisions. To submit a valid infringement claim, please provide the following information:

Notice of Infringement – Claim

  1. A physical or electronic signature of the copyright owner or an authorized representative.
  2. Identification of the copyrighted work claimed to be infringed.
  3. Identification of the material alleged to be infringing, including information sufficient for us to locate the material. [Providing the URL of the infringing page will help us identify the offending content].
  4. Contact information for the complaining party, including name, physical address, email address, phone number, and fax number.
  5. A statement affirming that the complaining party has a good faith belief that the material’s use is not authorized by the copyright owner.
  6. A statement certifying that the information in the notice is accurate and that the complaining party is authorized to act on behalf of the copyright owner under penalty of perjury.

Please be aware that under 17 USC §512(f), individuals who knowingly misrepresent material information in an infringement notice may be liable for damages, including costs and attorney fees.

Note that we may disclose the identity and details of any copyright infringement claim to the alleged infringer. By submitting a claim, you acknowledge and agree that your identity and claim details may be shared with the alleged infringer.

Counter Notification – Restoration of Material

If your material has been removed due to a copyright infringement claim and you wish to have it restored, you may submit a counter-notification to our DMCA Agent. This notification must include:

  1. Your physical or electronic signature.
  2. A description of the material that was removed and its original location before removal.
  3. A statement under penalty of perjury affirming your good faith belief that the material was removed due to a mistake or misidentification.
  4. Your name, address, and phone number, and a statement consenting to the jurisdiction of the federal district court in which your address is located (or, if outside the U.S., any judicial district where the service provider can be found), and that you will accept service of process from the original notifier.
  5. Submit your counter-notification via our Contact page. Email is preferred for timely processing.

Repeat Infringer Policy

We take copyright infringement very seriously. In compliance with the DMCA, we maintain records of DMCA notices and make reasonable efforts to identify repeat infringers. Accounts found to be in violation of our repeat infringer policy will be terminated.
